Minutes of January 6, 2016 approved.

Cagney, Tabor House Road (13-31) John Clarke presented a well replacement plan to replace a well that had been decommissioned in 1994.  The proposed site for the replacement well is in the immediate vicinity of the old well. The Board determined that the December 1994 decision to decommission the well on this property followed a decision by the State to maintain its classification of the landfill as a “significant threat” designation, because of insufficient data on groundwater flow.  Since the landfill is now capped, the Board felt that a well at this location does not pose a threat to human health and approved the proposed plan.

Wolf/Kegan, 127 State Road (33-15)   George Sourati presented a septic plan revision for a property which requires variances from Chilmark BOH Regulations.  He reported that achieving the 200’ separation from the Pond which is sought by the Board is only possible with a 24’ separation (instead of the 30’ required by Chilmark BOH Regulations) from the property line, due to archeological findings which constrain other options.   The Board determined that this variance will require a public hearing, and set the hearing date for its next scheduled meeting, February 3, at 5:50pm.  The Board asked Marina Lent to contact the affected abutter to provide notice in addition to the registered mailing which will go out from Sourati Engineering.

Khedouri, 10 Harbor Hill Road (27.1-101) Reid Silva presented a description of the tight tank removal/restoration process.  The Board approved  “phase one” of the project, namely the removal, assessment, testing, and, as appropriate, rehabbing of the existing tank with an epoxy paint coating as described in step 1. of the description submitted to the Board.  Reid Silva will bring a description of the process of assessing and securing placement of the tank after the restoration to a future meeting of the Board.

BOH 2016 Annual Report: The Board reviewed a draft annual report for submission, and suggested amendments.   Marina Lent will circulate an updated draft.

Irrigation Review:  The Board discussed the question of use of irrigation water with John Clarke.  In general, the Board discourages intensive irrigation, and noted that some areas of town, such as Squibnocket, are particularly sensitive to intensive water use.  The Board asked John Clarke to attend its scheduled meeting on February 17th to provide an overview and possible considerations for water use in Chilmark, especially in sensitive areas, going forward.

Raw milk testing:  Marina Lent reported having received a request from the Department of Public Health (DPH) Food Protection Program’s Dairy Unit on behalf of the Massachusetts Department of Agricultural Resources (MDAR) for the Chilmark Health Department to take on the task of conducting monthly raw milk sampling, which is normally conducted by MDAR dairy inspectors.  The Board felt that this is more work than the office can absorb at this time.  The Board felt that this task belongs to the State agency, and asked whether all communities in Massachusetts were being asked to shoulder this task at the local level.  At a minimum, the time involved should be compensated by the State, and the required equipment provided.  The Board noted that, if Island efforts to hire a shared, year-round food inspector were to bear fruit, this could be a consideration in the future.  The Board is willing to entertain further discussion with the State on this question, but declines moving ahead to take on this responsibility within the Chilmark Board of Health office at this time.

Grey Barn Farm Worker Housing:  Matt Poole reported to the Board that he had hear about a possible plumbing violation in a space used to house a farm-worker.  Apparently, wastewater from the washbasin in the barn structure does not discharge into an approved septic system.  Marina Lent reported that she had already been contacted by Eric Glasgow, who stated that the washbasin was already installed as-is when he purchased the barn, and that he had been unaware of its non-compliance.  He had assured her that he will remedy this situation. The Board asked Marina Lent to follow up on this matter.
